The Superior Court of Justice of Castilla y León confirms the sentence of three years in prison for a continued crime of aggravated fraud against a woman who posed as a psychologist . The Chamber has rejected the appeals filed, both by the convicted woman and by one of the victims, against the sentence of the Provincial Court of León.
In 1999, the accused founded an association to help combat gambling addiction . This association achieved a certain notoriety, being sometimes cited in the media at the provincial level Whatsapp Database and in the Castilian-Leonese community. The accused, especially among the residents of the town where she lived, posed as a professional psychologist and as the President of the aforementioned association. What's more, she sometimes went so far as to say that she was also a lawyer.
When said association was founded, its statutes stated that it would not have political, religious, lucrative or commercial motivation, however , the Provincial Court of León, and now ratified by the TSJ of Castilla y León, has proven that the accused had as sole purpose is to profit through said association at the expense of the naivety of people who come to it for illnesses, especially of a nutritional nature (anorexia or bulimia mainly) or also for psychological or mental disorders.
The accused was dedicated to contacting relatives of people who suffered from a disorder and offering them her help, claiming to be a psychologist and assuring that with her treatment, their relatives would improve.
The Provincial Court upheld the lawsuit filed by two families who were victims of the accused's illicit activity, condemning the false psychologist as the author of a continuing crime of aggravated fraud under article 250.1. 5th of the Penal Code to three years in prison. Likewise, he was also sentenced to compensate the family of one of the victims with the amount of 39,710 euros, and 18,809 euros to the second plaintiff victim.
