It may be whatever state that they handle the billing from. It's why alot of online companies are based out of specific states that don't have laws requiring them to tax up front. If I remember right, Amazon has actually threatened to relocate because Washington state wants to implement legislation requiring it.
Of course...you are supposed to claim online purchases on your taxes unless they tax you up front... soooooo
edit: I may be wrong on this... just looked up an article involving Amazon reaching deals with specific states with which they would tax consumers. Indiana being one of them that will begin to be taxed for online purchases in 2014.
Can anyone clarify this crap that knows?

I checked all my bank statements and no other MMO charged me tax. Why wouldn't they? Is SWTOR the first to do this? If so they might not be banking they tax but they are the first game to make us pay for it without telling us. That add profits to their pocket that other games choose to suck up

I read my state laws. Pretty much EA has to request to charge tax. After they do they can. I guess no other MMO gave a crap to do the paperwork for my state. I remove some of my anger, but my panties are in half twist still. Carry on people ignore my hot headedness.

Might be based on where Bioware or EA has offices. If a company has a physical presence in a state I believe they have to charge tax.

I think in TX (since BW offices are in Austin) they're trying to avoid potential legal issues. SWTOR game card at BestBuy charged tax too.
EDIT: Korrak, it has to be a "retail presence." Beyond that, I think it gets tricky.
